[其他] 关于指定国家核心技术等相关告示修改和施行

《关于指定国家核心技术等相关告示》部分修订案自2024年7月5日起施行(以下简称“修订告示”)。根据此修订,国家核心技术由13个领域的75项技术扩大或变更为13个领域的76项技术,主要修订内容如下。

 

  • 新指定4项对象技术

将技术优势相对突出、增长潜力巨大的四项技术—— 机械领域1项、核能领域2项及铁路领域1项——追加为国家核心技术进行保护。

在国家核心技术中移除已趋于一般化或普及化,保护必要性降低的3项核能领域技术。

在现有指定的国家核心技术体系中,对半导体、电气电子、汽车·铁路、钢铁、造船、宇宙、机械、机器人等8个领域的24项技术名称进行了调整,通过变更判断标准、细化或明确技术范畴,此举或引发国家核心技术范畴的实质性变迁。

根据《关于防止产业技术泄露及保护的法律》(以下简称为“产业技术保护法”)的规定,拥有被指定为国家核心技术的企业(“对象机构”)应当对该技术采取设定保护区域,管理国家核心技术专业人员,指定国家核心技术管理负责人等防止国家核心技术泄露所需的保护措施(《产业技术保护法》第10条),如果计划出口国家核心技术,应当获得产业通商资源部长官的批准或向其申报(《产业技术保护法》第11条)。此外,如果外国人计划收购或合并拥有国家核心技术的对象机构(“跨境并购”),也应当事前获得产业通商资源部长官的批准或向其申报(《产业技术保护法》第11条之2)。

 

因此,企业有必要审核其拥有的技术是否属于通过本次告示修订被新指定或因技术名称变更而范围改变的国家核心技术。如果确认拥有国家核心技术,则有必要对其进行严密审查,以能够合法遵守包括国家核心技术保护措施在内的《产业技术保护法》的各种规定。
