紹介

Ms. Amy Seunghyun Oh is a patent attorney and a member of the Chemical/Pharma Practice Group within Kim & Chang's Intellectual Property (IP) Group. Since joining the firm in 2006, Ms. Oh has been focusing her practice on various IP matters mostly associated with pharmaceuticals, biotechnology, and food sciences, including both patent prosecution and litigation, development and evaluation of patent portfolios, and analysis on patent validity and freedom-to-operate issues in connection with potential investments, licenses, and acquisitions.

In particular, Ms. Oh has extensive experience and expertise in handling administrative filings and lawsuits under the Patent-Drug Approval Linkage System in Korea (which is similar to the one under the Hatch-Waxman Act in the U.S.), and represents many brand name drug companies in ANDA-type litigations.

Built and managed a patent portfolio for a multinational pharmaceutical company to secure a patent barrier against biosimilars
Represented a cosmetic company in patent infringement and invalidation lawsuits against a competitor who improperly practiced the client's technology in violation of the license contract
Defended a seed company in litigation against a Plant Variety Right (PVR) owner who argued that the client's seeds are biologically identical to the PVR-protected seeds and constitute infringementConducted freedom-to-operate analyses for a food manufacturing process and provided validity/patentability opinions on multiple patents to assist a license contract
